What is a JCT management contract?

 

 A JCT management contract is a procurement route where the employer appoints a management contractor to manage and coordinate the works for a fee.

 

Rather than carrying out the construction directly, the management contractor enters into separate works contractors. This approach suits large projects where it’s required for work to start on-site before final designs are confirmed.

How are JCT contracts used in construction?

 

JCT is one of the most widely adopted contract suite in UK construction. They’re used most heavily in commercial building, residential development, education, healthcare and refurbishment. Their structured approach sets out the parties’ responsibilities, key timescales and payment arrangements, providing a clear framework for managing the project. 

 

JCT 2024 is the current edition of the suite. Although JCT 2016 was formally withdrawn on 31 March 2026, many existing projects and longer-term programmes will continue to operate under contracts entered into using the 2016 edition. Contract management software used across both existing and new projects should therefore be capable of supporting the relevant editions.

What’s the difference between JCT and NEC?

 

JCT and NEC are two widely used families of construction contracts, but they adopt different structures and management processes. Many JCT contracts follow a more traditional approach to contract administration, using mechanisms for instructions, payment certification, variations, extensions of time and loss and expense. The specific roles involved depend on the chosen JCT contract. For example, some contracts use a contract administrator, while the Design and Build Contract is administered through the Employer or Employer’s Agent.  NEC contracts place a strong emphasis on active contract management, early warning, programme management and the proactive management of risk and change.

 

The appropriate contract should not be selected solely according to whether a project is a building or infrastructure scheme. Selection should consider the procurement route, design responsibility, risk allocation, pricing structure, project complexity and the management approach required.
