What is FIDIC in contract management?

 

FIDIC is the International Federation of Consulting Engineers, which publishes a suite of standard-form contracts used internationally. Managing a project under a FIDIC contract involves following the procedures relevant to the selected form, including notices, claims, variations, payment and the assessment or determination of contractual matters. The exact roles, procedures and deadlines depend on the contract, edition and project-specific amendments.  Because FIDIC contracts are widely used on international projects, their administration may involve different currencies, languages and legal jurisdictions.

How are FIDIC contracts used in construction?

 

FIDIC contracts are internationally recognised standard forms used on construction and engineering projects around the world, including major infrastructure, energy, water and transport schemes. 

 

 

The Red, Yellow and Silver Books allocate design responsibility and project risk in different ways. The Red Book is generally used where the Employer provides most of the design, the Yellow Book where the Contractor undertakes the design, and the Silver Book for EPC and turnkey projects.

 

 

Both the 1999 and 2017 editions remain in use. Many existing projects continue to operate under the 1999 forms, while the 2017 editions may be selected for newer projects. Software used across a broad portfolio of FIDIC projects should therefore be capable of supporting the relevant contract and edition.

Are FIDIC contracts used in the UK?

 

Yes. FIDIC contracts can be used on UK projects, although NEC and JCT are more commonly associated with the domestic UK market.

 

 

 

 

FIDIC may be selected for projects involving international participants, funding arrangements or supply chains, and is also relevant to UK contractors and consultants working on overseas projects.

What is the difference between JCT and FIDIC?

 

JCT contracts were developed primarily for the UK construction market, while FIDIC contracts are internationally recognised and widely used on construction and engineering projects around the world.

 

The administrative roles depend on the contract selected. Many JCT forms use an Architect or Contract Administrator, although other forms use the Employer or Employer’s Agent. Under the FIDIC Red and Yellow Books, the Engineer performs an important contract administration and determination role, while other FIDIC forms use different arrangements.

 

FIDIC contracts contain detailed procedures for notices, claims and dispute resolution. Certain claims are subject to a 28-day notification period, although the requirements and consequences depend on the contract edition, amendments and applicable law. Disputes may progress through a DAB or DAAB, followed by amicable settlement and arbitration where they are not resolved.
