NEC4 ECS Contractor Instruction (CI) Template

Use this free downloadable template to help you create a Contractor Instruction under the NEC4 Engineering and Construction Subcontract (ECS). 

The ECS gives the Contractor wide ranging powers to issue instructions to the Subcontractor. Note, if an instruction will give rise to a compensation event, the Contractor is obliged to notify the Subcontractor of the compensation event at the time of giving the instruction. That notification can be given by using the compensation event templates.

You can use this NEC4 ECS template for a Contractor’s Instruction to do the following: 

  • Instruct under clause 14.3 to change the Subcontract Scope or a Key Date
  • Instruct under clause 17.1 stating how to resolve an ambiguity or inconsistency
  • Instruct under clause 17.2 to change the Subcontract Scope to remove something which is illegal or impossible
  • Instruct under clause 19.1 on how to deal with a prevention event
  • Instruct under clause 23.1 to submit particulars of design of an item of Equipment (period for reply is period for reply)
  • Instruct under clause 24.2 to remove a person
  • Notify under clause 26.4 of an agreement not to submit pricing information for a subsubcontract (main Options C, D and E) (period for reply is period for reply)
  • Instruct under clause 34.1 to stop or not start work, or to start or restart work
  • Instruct under clause 36.1 to submit a quotation for acceleration (period for reply is 2 weeks)
  • Instruct under clause 40.3 to correct a failure to comply with the quality plan
  • Instruct under 73.1 on how to deal with an object of value or historical interest
  • Instruct under clause X10.4(3) to submit a revised Information Execution Plan (period for reply is period for reply)
  • Instruct under clause X12.1(6) providing Partnering Information
  • Instruct under clause X21.5 changing the Scope, the Prices, the Completion Date and the Key Date following an acceptance of a quotation to reduce cost
